Marketing of Guimaras Mangoes to the United States Essay Example for Free

Marketing of Guimaras Mangoes to the United States Essay The meaty flesh of a mango fruit is sweet, but the fruits pit is so large and hard. Ripe mangoes are fragrant and soft to the touch, but not mushy. Mangoes can be processed into a number of unique products such as dried mangoes, puree, juice, chutney, halves and scoops, jelly jams, and pickles. A uniform quality and an adequate supply are assured throughout the year through processing. Processed mangoes enable exporters to serve their markets even during off season period for fresh mangoes. Also, exporters can penetrate buying countries with strict phytosanitary requirements by supplying processed mangoes. The distinct taste and nutritional value of Guimaras mango variety puts it above any other mango in the world. Mango is one of the priority crops being supported by the major programs of the Department of Agriculture (DA); Mangoes are included among the high value crops to be given priority under the High Value Crop Law. Distribution is an exceptionally important phase in the marketing of mangoes. The fruit after harvest has to pass through several agencies before reaching the consumers. The Philippines has already established its credibility in supplying high quality mangoes to important markets especially to the United States. The recent organization of the Philippine Mango Development Council provided the impulsion to unite the key players of the industry into a single advocacy group that will work together for the sustainable development of the Philippine Mango Industry. REVIEW OF RELATED LITERATURE One of man’s greatest triumphs in the cultivating of wild plants is the cultivated mango. Centuries of cultivation and selection produced a luscious fruit. Many varieties are grown in different countries. Here in the Philipines, Guimaras is known as the â€Å"Mango Country†, gaining the name because of its sweetest and big-sized mangoes. Based on the data of the National Statistical Coordination Board of the Republic of the Philippines, the year 2002 was a good year for Guimaras mangoes. It was in this year that it formally joined the world export market and cooperatively, production soared to its highest for the last three years. 2002 production posted a growth of 446.40 percent or five times higher over the 2001 production. Despite the decrease in the number of fruit-bearing trees, more trees were induced to flower as favored by the weather conditions. The Philippine mango, considered in western countries as an exotic tropical fruit, is fast gaining popularity worldwide. It is the third biggest dollar earning fruit next to banana and pineapple. But competition from other countries has led to stricter international standard controls for mango and the fruits produced in Pangasinan and the other Ilocos provinces have yet to meet quality standards demanded by the United States. The United States may open its market to Philippine mangoes, with that country’s agriculture department funding a survey to find out which mango-producing areas have no incidence of mango seed and pulp weevils. Major importers of Philippine mangoes in the United States are looking forward to less costly mangoes from Manila with the decision by the US government in December to allow other provinces in the Philippines to export the produce. A United States-based Philippine official has revealed the introduction of a technology that would help cut down the shipping cost of Philippine mango exports to that country. Eventually, such technology would also allow mangoes from other areas of the country to enter the US market. Presently, only mangoes from Guimaras Island have been allowed in the US. According to Victoriano Leviste, agriculture attachà © at the Philippine embassy in Washington DC, The key is to create a niche market through our Filipino residents and possibly other Asians. Philippine Super Mango (carabao) has been gaining popularity in the US market as a sweet and more luscious fruit. The Philippine mango, coming from Guimaras Province in the Visayas, was only able to enter the US market in May, last year, after 15 years of negotiations with the US Department of Agriculture. Only Guimaras mangoes are so far accepted in the US. Mangoes from other areas of the country allegedly have fruit flies. Guimaras has been considered a pest-free zone and an ideal source of mango exports to the US. It is encouraging to note that the importance of the mango industry to the Philippine economy is now being recognized by all concerned sectors. The mango industry has provided livelihood opportunities to its growers and to those involved in its marketing channels. Similarly important is its significant contribution to the countrys export earnings being the third ranking fruit export, next to banana and pineapple. The Philippines is one of the top mango producing countries in the world with an estimated 2% share of the worlds 23.4 million tons production in 1997. The other top mango producing countries are India where 51% of total world production of mangoes comes from, China with 9% share. Mexico and Thailand both with 6% share. Exporting is one factor that helps our economy to sustain its stability with different problems it encounters. The need for unity among mango growers here in the Philippines is very important to be able to enhance the competitiveness of our own mangoes both in the local and world market. The recent formation of the Philippine Mango Development Council (Philmango), which was initiated by the DA Agribusiness and Marketing Assistance Service (AMAS), is a big step towards the proper orchestration of strategic interventions for the mango industry. CONCLUSION Mangoes from Guimaras indeed goes beyond quality and taste compared with other mangoes exported from different countries. The target of introducing and marketing of mangoes produced from different regions here in the Philippines to the United States should be endorsed. Only mangoes from Guimaras passed the standards in the United States. In order for our mango producers to enter the US market, there should be proper technology to assure consistent quality and supply. The bulk of the countrys mango output are grown in backyard farms which makes it hard to assure uniform and consistent supply of mangoes. There are limited commercial farms, and exports are basically consolidation of produce from backyard orchards and small farms. Also, the lack of commercial technology in the packaging and in preserving the freshness to offset the long stretch from the source to distant foreign markets such as the United States should also be taken into consideration. Lastly, inefficiency and high freight charges from the local shipping industry caused so much burden. It adversely affected the smooth delivery of mangoes to its markets. Mangoes coming from Visayas and Mindanao should be transported to Manila before it is exported to foreign countries; the significant increase of price due to high transport costs makes it difficult to reach its destination. Every day, I came to meet and bump with different people. And these persons gave another dimension in my life. My second family, the organizations I have here in school also welcomed me. But there is indeed a significant difference with the way they care for each members. My family treats me, accepts me and understands me for the person I am. They believed in my capabilities and support me with my ambitions in life. My family gives me inspiration in everything I do. I can count on them especially in times when I experienced the down moments of my life. There was never a time when they left my side. On the other hand, my second family also gives another meaning in my life. Though I am part of the family, there is no assurance that they will always be there for me through thick or thin. They also have their priorities in life. Though they can be there when I a want shoulder to cry on, or help me out with problems in school but it is just temporary. They all come and go. Abstract Mango is one of the commercially and economically essential horticultural fruit crops in the Philippines. It is the third most important fruit crop, next to banana and pineapple in terms of dollars earned. It is considered as a national fruit in this country. Mangoes specifically coming from Guimaras can be eaten ripe or unripe. It is very popular around the world because of its exotic taste. The paper aims to exemplify the export of these mangoes which placed the country’s competitiveness in the world market and how it captured the United States.

Sexual Assault in the Army

Sexual Assault in the Army â€Å"The Invisible War† Sexual Assault  against Women in the Army In 2012 a documentary entitled â€Å"The Invisible War† dealing with sexual assault against women raised attention to an issue that has been rarely spoken about. As an issue, it has been gaining attention in recent years however, and even President Obama (Office of the Press Secretary, 2014) describes it as a â€Å"profound injustice† in a speech he made in January. Sexual assault in the army affects a certain category of the American population that is abused. This paper will focus mainly on veteran women, explaining the causes behind their victimization, the measures the U.S officials have been trying to implement to limit such incidents, and finally it will provide some real study cases. The Report to the President of the United States on Sexual Assault Prevention and Response (Depatment of Defense., 2014) came as a response to president Obama’s request to the defense department to improve their policies against sexual assault in the military system. It defines sexual assault as â€Å"[intentional] sexual contact characterized by use of force, threats, intimidation, or abuse of authority or when the victim does not or cannot consent† (2014). Based on this definition, the rapport states that the number of victims of sexual assault between 2013 and 2014 are as follows: 4,3% for women and 0,9% for men. It also shows that despite the increase in 2012 concerning the number of sexual assault cases against women in the army, there is a decline from 6,1% to 4,3% in 2014 (same as 2010). In simpler terms, women are 5 times more likely to get sexually assaulted than men in the army. These figures imply an aggressiveness against women in particular considering that veteran women make up only 14,5% of the active-duty force (Statistics on Women in the Military, 2011). Some would explain this behavior through the feminist theory; that sexual violence against women is a way for men to reinforce their power, hence label it as a gender issue (Peterson Bailey, 1992; Hagan Peterson, 1995; Baron Straus, 1987). In chapter eight of Crime and Inequality (Hagan Peterson, 1995), the writers explore different surveys and experiments made to prove the relationship between gender inequality and violence against women, especially rape. They argue that such violence is intended to â€Å"keep women in their place† (1995). Clark and Lewis (1997) also argue that in societies where women are regarded as possessions of men, it is more likely that men would exercise their power by forcing and threatening women into sexual activities (cited in Baron Straus, 1987). Although this theory does not relate to women in the army in particular, but it tries to establish the relationship between the socioeconomic inequality between men and women from one hand, and the sexual abuse women suffer from. (Hagan Peterson, 1995). â€Å"The central argument is that rape is rooted in male domination of sociopolitical and economic activities (Williams and Holmes 1981). Thus, rape is expected to be more common where women hold little political or economic power [†¦] and the occupational status of women is inferiorâ€Å" (Peterson Bailey, 1992). In Addition to the view that men assault women sexually to reinforce their power, sexual assault might be attributed to some other causes. One of the main factors which are associated with high risk of rape, in particular, is the work place environment. Veteran women share their sleeping quarters with male soldiers which provide an environment in which the assailant has an easier access. Women also may experience pressure and may be obliged to hear demeaning comments or gestures (Sadler, Booth, Cook, Doebbeling, 2003). According to Pauline Jelinek (2012) in her article â€Å"military alcohol abuse ‘culture’ is now a ‘crisis’.† It is known that drinking alcohol and consuming drugs within the ranks of the military is a ‘culture’, and is considered as an escape from what they experience in the war. However, this has numerous drawbacks such as sexual aggression against veteran women. In fact, it is reported that half of perpetrators in the military are under the influence of alcohol or drugs at the time of (Sadler, Booth, Cook, Doebbeling, 2003). Man’s tendency to act violently is another factor associated with high rate of rape. This is proven by a meta-analysis of sex difference in physical aggression. It shows that men are more likely to act violently and that 62 per cent of those who are injured by a partner are women (Archer, 2000). This is explained by what Melissa M. McDonald, Carlos David Navarrete and Mark Van Vugt (2012) call â€Å"The male warrior hypothesis.† They argue that men are programmed to act aggressively â€Å"to gain access to mates, territory and increased status.† This tendency to act violently can be interpreted as one major cause of sexual assault. Furthermore, women’s silence increases the rate of rape. This is attributed to barriers to justice where women feel that they are at risk of retaliation by the assailants. In fact, offenders usually outrank the victims and consequently, women are obliged to make a choice between their military career or seeking justice. What is worse is that commanders not only fail to enforce the protection of those women but also they put the blame on women for ruining the careers of â€Å"good soldiers† claiming that this is not â€Å"a big deal† and â€Å"not worth causing conflict in the unit† (Stalsburg, 2011). Despite the existence of sexual crimes in the military, a great number of methods and victim assistance programs have been actually implemented by the American army to prevent the occurrence of such cases. â€Å"Bystander Intervention Training† provided by the Department of Defence is one of the methods that encourages and shows all the service members how â€Å"to intervene safely when they see situations at risk for sexual assault† (U.S. Commission on Civil Rights, 2013). Another training that only commanders receive is â€Å"The command training and efforts to address sexual assault† (2013). It teaches commanders to assume an effectual responsibility by adopting certain rules and initiating some directions. It trains therefore high ranked officers to prevent the setting up of â€Å"environments that foster sexual harassment†(2013). As far as the military response to victims is concerned, two major reporting options are available for military members to opt for. The first, the unrestricted reporting option, implies â€Å"criminal investigation in which command and law enforcement are provided with details of the incidents† (U.S. Commission on Civil Rights, 2013). The restricted reporting option, on the other hand, provides help for victims in terms of â€Å"medical and healthcare,† but it does not imply an official investigation. This option is made specifically for women who prefer not to reveal the harasser’s identity or to call legally for their rights. In addition to these methods, â€Å"every military installation has a Sexual Assault Response Coordinator (SARC) and at least one Victim Advocate [who is] responsible for connecting victims with appropriate resources and services† (U.S. Commission on Civil Rights, 2013). Although several measures have been adopted in the military, most women being raped prefer to be silent and not to uncover the truth. Even though America have the most powerful army in the world, it has in its ranks a secret –an invisible story- that many women won’t dare to reveal. However, in 2012 these women decided to break this silence and speak out in an investigative and a documentary film entitled â€Å"The Invisible War† (2012) which evolved around the sexual assault and harassment in the US military. This film aided these women to uncover the truth, tell their stories and share their experiences. One of these women is ‘Kori Cioca’ who was serving â€Å"in the US coast guard and was stationed in Michigan† and was raped by one of the commander officers back in 2005 (Stebner, 2013). During the aggression and while calling for help, her assaulter hit her and broke her jaw. She didn’t have the courage to report this incident because of the threats she received and the fear of losing her job (Stebner, 2013). In her article â€Å"the Invisible War: New Film Exposes Rape, Sexual Assault Epidemic in U.S Military† Amy Goodman (2012) interviewed Ms. Cioca where she told her horrible story about the aggression. In fact, her superior began by harassing her verbally but she refused these sexual suggestions. She said â€Å"he didn’t rape me because I was pretty or that he wanted to have sex with me; he raped me because he hated me, and he wanted to show me that I wasn’t as great as I thought I was.† This statement can be interpreted in favor of the feminist view of sexual assault discussed earlier. As for the victim, she thought about committing suicide but she changed her mind when she knew that she’s pregnant. Until now, although she feels traumatized and fights everyday to win her right back, she remains hopeful and confident that one day justice will take its course. To sum up, sexual assault against women has been an ‘invisible war’, a blight in the most honorable institution like the U.S. military. Its causes go back to different factors; human nature in general and the environment of the army in particular. The U.S officials and mainly the department of defense have been implementing different measures in the different levels of the armed forces to eliminate this problem. However, what the story of Kori Cioca reveal can imply the limits of such measures and the commitment to stop this sexual aggressiveness against women. References: Archer, J. (2000). Emperor Claudius Essay -- essays research papers

Introduction Tiberius Claudius Nero Germanicus (b. 10 BC, d. 54 A.D.; emperor, 41-54 A.D.) was the third emperor of the Julio-Claudian dynasty. His reign represents a turning point in the history of the Principate for a number of reasons, not the least for the manner of his accession and the implications it carried for the nature of the office. During his reign he promoted administrators who did not belong to the senatorial or equestrian classes, and was later vilified by authors who did. He followed Caesar in carrying Roman arms across the English Channel into Britain but, unlike his predecessor, he initiated the full-scale annexation of Britain as a province, which remains today the most closely studied corner of the Roman Empire. His relationships with his wives and children provide detailed insights into the perennial difficulties of the succession problem faced by all Roman Emperors. His final settlement in this regard was not lucky: he adopted his fourth wife's son, who was to reign catastr ophically as Nero and bring the dynasty to an end. Claudius's reign, therefore, was a mixture of successes and failures that leads into the last phase of the Julio-Claudian line. Early Life (10 BC - 41 A.D.) Claudius was born on 1 August 10 BC at Lugdunum in Gaul, into the heart of the Julio-Claudian dynasty: he was the son of Drusus Claudius Nero, the son of Augustus's wife Livia, and Antonia, the daughter of Mark Antony. His uncle, Tiberius, went on to become emperor in AD 14 and his brother Germanicus was marked out for succession to the purple when, in AD 4, he was adopted by Tiberius. It might be expected that Claudius, as a well-connected imperial prince, would have enjoyed the active public life customary for young men of his standing but this was not the case. In an age that despised weakness, Claudius was unfortunate enough to have been born with defects. He limped, he drooled, he stuttered and was constantly ill. His family members mistook these physical debilities as reflective of mental infirmity and generally kept him out of the public eye as an embarrassment. A sign of this familial disdain is that he remained under guardianship, like a woman, even after he had reached the age of majority. Suetonius, in particular, preserves comments of Antonia, his mother, and Livia, his grandmother, which are particularly cruel in their assessment of the boy. From t... ...and cautious nature, he had a cruel streak, as suggested by his addiction to gladiatorial games and his fondness for watching his defeated opponents executed. He conducted closed-door trials of leading citizens that frequently resulted in their ruin or deaths -- an unprecedented and tyrannical pattern of behavior. He had his wife Messalina executed, and he personally presided over a court in the Praetorian Camp in which many of her hangers-on lost their lives. He abandoned his own son Britannicus to his fate and favored the advancement of Nero as his successor. At the same time, his reign was marked by some notable successes: the invasion of Britain, stability and good government in the provinces, and successful management of client kingdoms. Claudius, then, is a more enigmatic figure than the other Julio-Claudian emperors: at once careful, intelligent, aware and respectful of tradition, but given to bouts of rage and cruelty, willing to sacrifice precedent to expediency, and utt erly ruthless in his treatment of those who crossed him. Augustus's suspicion that there was more to the timid Claudius than met the eye was more than fully borne out by the events of his unexpected reign.

The Effect of Communication Theories in Business Introduction

The effect of communication theories in business Introduction Communication has existed since the beginning of human beings, but people didn’t pay attention to it until the 20th century, especially into the 21st century along with the communication technologies development. Nowadays, there have many communication theories. Among of these theories, interpersonal communication (IC) and organizational communication (OC) are the most commonly-used theories applied in business to help us resolve problems. IC, as a kind of device that organizers usually use to communicate with their employees, more emphasizes individuals interacting face-to-face than OC. It can help us understand how and why people think and behave. However, IC is hardly defined in its own area of study, yet often occurs within other environment like organizations (â€Å"Interpersonal communication,† In Wikipedia, The Free Encyclopedia, 2011). OC, as a subfield of communication, mainly looks at human communication within or among organizations, which is the most basic and central part in business management (Simon, 1998). It relates to the achievement of organizational goals and the formation of organizational culture. Meanwhile, OC is also the most common management behavior which is carried out under certain circumstance and is influenced by organizational culture. The behavior culture of enterprises determines the behavior characteristics and communication ways and styles of employees; the material culture determines the condition of communication technology, communication mediums and channels of companies (â€Å"Organizational Communication†, In Baidu, The Free Encyclopedia, 2011 ). Interpersonal Communication and Organizational Communication in Business In the process of actual application in business, OC is often considered as one field of IC and IC as one means of OC on the contrary. These two communication theories seemingly serve different objects, people versus organizations. Actually, individuals are the common objects of communication. Communication scholars define OC different from IC, only because it always exists in an organization, and sometimes represents one department or one class. So we could see both of them usually work together in one organization. For example, the enterprise culture of General Electric (GE) Company highlights the â€Å"people-oriented† business philosophy. In GE Company, employees are given enough concern and respect, and are encouraged to express their opinions and display their creativity directly. This kind of outspoken communication style of GE makes managers gain more new ideas and opinions to impel company developing. Moreover, for the management coordination, the ex-CEO of GE, Jack Welch, came up with â€Å"boundaryless concept† in the field of organizational communication. GE Company would clear obstacles among all departments like engineering, production and marketing departments and make information totally transparent and free accessible. Under the guidance of such communication theories, GE could use internal information with the most efficiency and achieve the resources sharing on the largest extent (In Scientology Volunteer Minister, 2009). In this case, we hardly tell which communication theory is applied in certain part, yet we easily find the two theories complement and serve each other. The application of communication theories in organization Use to cope with internal problems Communication, as one kind of enterprises culture, has attracted more attention of companies and is treated as the key point of strategic management by leadership. The â€Å"Three Withouts† phenomenon Mr. Yu (2008) came up with in one speech, as the following, is the most direct and understandable explanation of the problems existed in organizations. Lack of Communication with Superiors. Generally speaking, there are many things managers have to think about so that they cannot communicate with employees efficiently in time (Shiwei Yu, 2008). At this time employees are supposed to report actively to superiors, yet most of them have no courage to talk with superiors. There have two performances in this situation. The one performance is that people dare not or are not willing to communicate with superiors when they have good ideas, because either they are overconfident and have no interest any more after several negations by leaders, or they lack of confidence and are afraid of criticism. The other one is that individuals do not report to managers when they find potential problems existed in work. The reason can be concluded that people who are over-dependent on leadership always follow their leaders and have no question to them. Actually, whichever kind of employees is irresponsible for work. In fact, even though we are just the employees, we should consider issues in the sight of the enterprise rather than individuals and adjust our attitude from â€Å"responsible for leadership† to â€Å"responsible for enterprise†. Lack of Communication between Departments. In the most companies, it has been the main problem that different departments hardly communicate sincerely with each other and have no sense of mutual support and positive cooperation (Shiwei Yu, 2008). To resolve the problem, enterprise should firstly review whether the department position of it is reasonable, and then establish the relation mode of â€Å"suppliers and customers† among the all departments, consequently foster the sense of service for different department, so that employees can communicate with sincerity and make efforts together to achieve the goal of enterprise. Virtually, the whole process of resolution is the process of OP applying. Lack of Communication with Subordinates Superiors involved in other business seldom talk with employees, let alone instruct and advice their work, which is responsible for the phenomenon that increasing companies spend over one month in recruiting and training new staff, yet don’t have one day to communicate with their employees(Shiwei Yu). The reason could be conclude as the following two sides: Managers prefer enjoy the feel at high stand to communicate with employees personally. We have to acknowledge that there exist such managers who are arbitrary and hardly accept opinions from the inferiors. If they invariably ignore the subordinate advice and views, it would only discourage the enthusiasm and responsibility of staff. Certainly, there have a latent yet inevitable reason that managers are afraid of being transcended by the subordinate. In addition, it is also an important problem that superiors communicate with inferiors without skills. For the leadership, effective communication not only promotes work smoothly, but also helps to establish their image. Furthermore, as the managers, they have rights and obligations to communicate with inferiors actively as well as know and develop capability and responsibility of employees, just like Toyota Motor Corporation CEO spends two thirds time in chatting with engineers and dealers, while the Boeing Company CEO invites the senior managers to share their exciting stories, and the leadership of Ericsson helps employees make personal development plans every year (Communication Case Study, 2009). Use to cope with external problems Nowadays many companies have the experiences using communications theories to help themselves alleviate crisis and maintain their stable development. Facing crises from exterior factors, companies should first think about how to coordinate each department and communicate with consumers (â€Å"Communication Theories†, In MBAlib, The MBA Encyclopedia, 2010)? What we need to know is that consumers are inclined to the attitude companies express to event rather than the fact itself that is happened. Clients could forgive your mistakes, yet not accept your ignorance. So when the problems occurred, enterprises should first respond and express the determination to deal with them. That is to say, communication is the principal method to resolve problems. The â€Å"Sudan I† event KFC suffered is a wonderful example to support the statement. On March 15th 2005, all KFC outlets in China were found using banned dye Sudan I, the cancer-causing colorant in the sauce of New Orleans roast chicken wings and chicken hamburgers. And then many consumers sued KFC and asked it for their injury compensation. As we know, KFC has been successful in China since it first stepped in the Chinese market in 1987; however this event made KFC loss a large number of customers in a short time. According to a survey, the loss rate of clients of KFC raised to unprecedented 50% in over half stores. Facing a series of emergencies, KFC responded in first time, at that night of event exposure. All KFC outlets stopped selling New Orleans roast chicken wings and chicken hamburgers at the next day, destroyed all rest sauce and posted bulletins in all stores for apology. Each department was connected. Meanwhile, the managers of KFC actively contacted with the victims and accounted for the event as well as the results of survey to eliminate doubts of the public. From the example, we could find the application of communication theories is used in every details of the process of event resolving. First of all, just because of the effective organizational communication taken, all departments and outlets could act in concert to calm the storm immediately. Furthermore, the manager even communicated with customers in person in order to express their apology and sincerity. So IC could be applied more among individuals to achieve what we want. How to ameliorate business communication As we all know, the effective communication between managers and employees depends on the negotiability and share of information in internal organization and is responsible for improving the work efficiency and enhancing decision scientificity and rationality. So how to ameliorate business communication ? The aspect of interpersonal communication 1. Adjust the attitude of communication Along with the information network and communication technology advancement in modern society, the ways of communication between individuals become more various and richer than ever before. On the surface, the connection is indeed increasingly frequent and intimate, yet what is the fact? Most communication has been driven by material benefits. So communicators in business should make much account of not only the process of systematized information communication, but the spiritual communication (HRoot, 2010). 2. Learn to listen Tracey once suggested that the managers of human resource should spend 65% in listening, 25% in speaking and 10% in reading and writing (2006). Thus we could see the significance of listening for communication. More important, only by listening can we detect the others’ heart and logical thinking, communicate with them better and finally attain the objective. 3. Put emphases on nonverbal expression Nonverbal information includes expression, pronunciation and intonation, gesture and so on. Actually this kind of communication more easily touches people than language performance. So weather you send or receive messages, you should notice the power and effect of nonverbal expression. The aspect of organizational organization 1. Speech with confidence Speech is a quite fundamental and common part of OC. For most people, talking is considered as a normal activity, yet speech often make individuals nervous and overwhelmed. However, we often could be asked for speech in formal occasions, even though just several sentences. When we make a speech in a formal occasion, we should keep our speech tempo slow enough and volume loud enough to make ourselves heard by everyone. Meanwhile, we should realize that appropriate words, image and posture are helpful for people understanding (HRoot, 2010). 2. Organize effective conference Conference as one kind of formal communication is indispensable part of OC. The elaborate plan and explicit theme are the primary guarantee to accomplish the goal of meeting. Moreover, when you chair a meeting, you should notice weather the atmosphere is accustomed to listening or communicating, thereby mastering initiative in the activity of communication. Conclusion American famous futurist (1999), John Naisbitt, said â€Å"The competition of future is the competition of management. The focus of management competition lies in the effective communication among the staff of each social organization and the organizations themselves. This sentence simply and accurately points out the essentials and significance of IC and OC for enterprise management. From the above discussion about communication theories, we could see that communication has been an effective tool for modern management. Only through effective IC, the ideas and suggestion from employees could be taken seriously; only by effective OC could the performance of organizational members be appraised a nd recognized. In one organization, whether IC or OC is all to share and utilize resources better, consequently maintain the sustainable development. Reference Homans, G. C. Algaziyev Assylbek Essays - Contract Law, Law, Money, Finance

Algaziyev Assylbek Essays - Contract Law, Law, Money, Finance Algaziyev Assylbek BIB A4007536 The issue which needs to be discussed is whether how Archie, Bob and Pat can get their original debts back from Esenes. Before I will give some advises for Archie, Bob and Pat I would explain what means accord and satisfaction, consideration and accord as an equitable defense. Accord and Satisfaction Accord and satisfaction is a contract law concept about the purchase of the release from a debt obligation. The payment is typically less than what is owed and is not paid by the actual performance of the original obligation. The accord is the agreement to discharge the obligation and the satisfaction is the legal "consideration" which binds the parties to the agreement. If a person is sued over an alleged debt they bear the burden of proving the affirmative defense of accord and satisfaction Consideration In an accord contract it is typical that the consideration supplied is less than bargained for in the original contract. In accord contracts that require an amount of consideration that is less than the original, the consideration must be of a different type, i.e. instead of money, debtor offers a car or a boat. Accord as an Equitable Defense A valid accord does not discharge the prior contract, it suspends the right to enforce it in accordance with the terms of the accord contract, in which satisfaction, or performance of the contract will discharge both contracts (the original and the accord). If the creditor breaches the accord, then the debtor will be able to bring up the existence of the accord in order to enjoin any action against him The accord agreement must be transacted on a new agreement. It must therefore have the essential terms of a contract, (parties, subject matter, time for performance, and consideration). If there is a breach of the accord there will be no "satisfaction" which will give rise to a breach of accord. In this instance the non-offending party has the right to sue under either the original contract or the accord agreement Advises In the first case with Archie we can see a negotiable instrument. A negotiable instrument can function as a substitute for money or as an extension of credit. For example: when buyer writes check to pay for goods, the check serves as a substitute for money. When a buyer gives a seller a promissory note in which the buyer promises to pay the seller the purchase price within sixty days, the seller has extended credit to the buyer for a sixty days, the seller has essentially extended credit to the buyer for a sixty day-period. For a negotiable instrument to operate practically as either a substitute for money or a credit device, or both, it is essential that the instrument be easily transferable without danger of being uncollectible. This is a fundamental function of negotiable instrument. A s Archie gladly accepted an invitation to the launch party instead of payment negotiable instrument can be seen. M oreover Archie was in accord and satisf ied which does not give him chance to sue and win a court Esenes therefore get the original debt from Esenes. In the second occasion with Bob as case Foakes v Beer states that " Mrs. B obtained a judgment for debt against Dr F in the sum of 2,090. The parties agreed that if Dr F paid 500 at once and the balance by installments Mrs . B would not take "any proceedings whatever on the judgment debt. Dr. F paid 2090 but Mrs. B then claimed interest on the judgment debt. Dr F had to pay the interest. The agreement between the parties did not help him because it was unsupported by consideration " according to that case as Bob reluctantly agreed to accept it in full and final payment of her debt there was no consideration between Bob and Esenes therefore it enables Bob to get the original debt and interest as well. For a Pat I could advise to refer to Hirachand Punamchand v Temple case which states that "Creditor accepted a smaller sum from the debtor's father in full settlement. The creditor could not sue the debtor for the balance as it would be a fraud on the father to

The Catcher in the Rye Essays - Literary Realism, Free Essays

The Catcher in the Rye Essays - Literary Realism, Free Essays The Catcher in the Rye - foreshadowing - The use of forshadowing in a novel can help it's reader get a sense of what is to come in the story without giving away the events themselves. It is a powerful tool which prevents events from being left unexplained, leaving the reader question the effectivness of an outcome. The eventual breakdown of the character Holden Caufield in J.D. Salinger's controversial 1945 novel "The Catcher in the Rye" was foreshadowed in the early chapters of the book. The first clue is his negative approach to life. He begins by talking about his "lousy childhood" (p.1) and the first traces of profanity can be seen scattered about the page in the form of "crap", "hell" and "goddam". Holden's first sign of distrust comes when he speaks to Ward Stradlater about his date with Jane Gallagher: "Listen. Give my regards, willya?" "Okay," Stradlater said, but I knew he probably wouldn't... "Ask her if she still keeps all her kings in the back row." "Okay," Stradlater said, but I knew he wouldn't. (p.33-34) This is seen again when he doesn't trust Stradlater to stop his advances of Jane in the case that she says no. Holden gives up his faith in people to trust him when he boards a bus holding a snowball. The driver refuses to believe that Holden won't throw the snowball so he draws the conclusion that "People never believe you." (p.37). He is also always placing labels upon people as being "phonies" which gives the reader the idea that Holden thinks that others are materialistic. Holdens attempts to protect the innocence in the world is another early sign of his deteriorating state. When Holden goes to Pheobe's school to deliver his note he sees some swearing of the wall which he says "drove me damn near crazy" (p.201). He wipes the words from the wall in an attempt to prevent the inevitable from occuring, leading the reader to believe that he may experience some mental unstability in the future. Eventually he comes to the realization that he can't rub all the profanity away himself. Another example of Holden's attempt to shelter innocence is the fact that he never does call Jane, possibly for fear that she will scar his memories of her as an innocent child. The title of this novel presents this theme to the reader in that Holden wants to be "the catcher in the rye" (p. ) so he can catch all of the children that sway to close to the edge of a cliff in thier play. Perhaps the most obvious example of foreshadowing in the novel occurs when his parents come close to having him "phsycoanalyzed and all" (p.39) when he breaks all the windows in the garage. Throughout the novel he refers to himself as "a madman" (p.79) which gives the reader the idea that he sees himself as having a sort of mental problem. These two peices of evidence alone present a fairly firm idea of what will happen to Holden towards the end of the story. The use of foreshadowing is evident in the novel "The Catcher in the Rye". It does it's job well in that it foretells the outcome of Holdens many problems and gives reason for it. The eventual breakdown of Holden is not startling to the reader because of the authors use of foreshadowing and therefore it is effective.

Critical thinking exercise Essay Example | Topics and Well Written Essays - 1500 words

Critical thinking exercise - Essay Example In a sense Carey uses some of the ideas of the Enlightenment in reverse: thus the argument that systematic, scientific thinking could provide truths and laws about even the most complex of human relationships is reversed by Carey. He suggests that tracing the influence of the invention of a communication device must rely upon more than a seeking for the objective truth. But the method that Carey uses for convincing his readers actually borrows a lot from the scientific method. He argues that the telegraph shifted the nature of human culture because it freed communication from transportation. Until this point, messages between individuals (or between countries) needed to be transported physically from place to place, either by foot, horse or latterly, the railroad. The telegraph allowed messages to move independently of other forms of transportation. Thus Carey looks at something which was fairly obvious in a new manner: - just as a scientist will explore phenomena that are seen by human beings every day in a new manner in order to explain them. The scientific method continues as the telegraphy is seen as a driver for a number of actions and reactions within society. It led to the eventual disappearance of certain kinds of writing, and even changed the manner in which human beings saw time. ... Now people could communicate instantly with others who were living in a different time zone. His discussion of language turns more to the precepts of Modernism - as he both uses some of its ideas and also explains some of the changes that occurred through the invention of the telegraph. The telegraph enabled news to travel 'instantly' from one side of the country to another, but due to the cost involved, the words used to describe events was constantly cut. Carey terms this as "the lowest common denominator" and thus language was reduced to its basic components. Colloquial English that could only be understood within a particular locality could not be used in nationwide news reporting. Short, simple descriptive sentences took over from the more long-winded, flowery language of before. It is this new type of language that comes to dominate, and even spreads into the work of "great writers" such as Ernest Hemingway. Hemingway was known for using short, simple sentences that could be understood by anyone with even a basic education. While the ideas behind the words might be only accessible to the few, a whole mass of the population could now read, understand and even enjoy elite literature. The telegraph thus led to a democratization of both language and literature within Modernism. Modernism itself was characterized by the tendency to reject the old dichotomies between "high" and "low" art; it also rejected the idea of dividing knowledge into that which was 'objective' and that which was 'subjective'. All human behavior and knowledge was questioned and problematized within the Modernist perspective, as shown by Carey's own argument. Along with a

MIH548 - Theory Based Research - Mod 4 Case Assignment Essay

MIH548 - Theory Based Research - Mod 4 Case Assignment - Essay Example This was a quasi-experimental design. This type of research is meant to find a cause and effect relationship when there are independent and dependent variables. The goal is to find out if a specific intervention affected the outcome (Burns & Grove, 2007). In this particular case, the goal would be to find out if the $25 incentive improved the number of people at risk for HIV that went for testing and follow up. The study is an experiment as there is a control group used to measure against. There were 372 patients referred during the three periods that were tracked. During the control periods in which the incentive was not offered, 20 of 252(8%) patients completed HIV counseling and testing while during the incentive period 27 of the 120 (23%) patients completed testing and counseling. There was a statistically significant difference in the groups that showed in race and ethnicity. This had to be accounted for by using a multivariable logistic regression model. The result was that there was still a statistical difference in the two groups. The conclusion from this was that there is a increased proportion of patients who complete testing and counseling when a small financial incentive is used. However, there was not a significant answer as to whether there were more positive patients found in this manner and whether this program would be worth its cost. There will need to be further clinical studies to determine these answers. The study was performed over three consecutive 6 month periods resulting in two control groups and an experimental group. This might have been a better experiment if it had been conducted over the full year and 1/2 randomly assigning patients to the different groups. In setting up the groups the way they did for this particular clinical experiment, they did not realize their bias in one group toward one ethnic group until it was too late. Had they randomly assigned
